Important: By creating an account, purchasing a plan, uploading or downloading a file, generating a reseller key, participating in the affiliate programme, or otherwise using MEGALOAD, you agree to these Terms. Mandatory consumer and data-protection rights remain unaffected.
1. Acceptance, eligibility and contract
These Terms of Use and Acceptable Use Policy (the “Terms”) form a binding agreement between you and the operator of the MEGALOAD service (“MEGALOAD”, “we”, “us” or “our”). The operator’s legally required business and tax details are shown during an applicable paid transaction, on the related invoice, or are available through Support.
You may use the Service only if you have legal capacity to enter into this agreement. If you use the Service for a company or another organisation, you confirm that you are authorised to bind that organisation. The Service is not directed to children. A minor may use it only where permitted by applicable law and with valid consent or supervision from a parent or legal guardian.
If you do not agree to these Terms, do not use the Service. Specific product, checkout, reseller, affiliate or promotional terms displayed before an action form part of this agreement. If they conflict with these Terms, the more specific terms govern that action, except where mandatory law requires otherwise.
2. The MEGALOAD Service
MEGALOAD provides hosted file storage, uploads, downloads, sharing links, account management, desktop transfer software and related features. Some functions may be available only to particular plans, countries, verified users, approved resellers or approved affiliates.
We may introduce, update, replace or discontinue features for security, legal, operational or product reasons. Where a material change negatively affects a paid digital service beyond a minor degree, we will provide the notice and remedies required by applicable consumer law.
MEGALOAD is a hosting provider and does not claim ownership of user files. We do not endorse user content and users remain responsible for what they upload, store, share or download.
3. Accounts and security
- You must provide accurate information and keep account details current.
- You are responsible for activity performed through your account, reseller panel, affiliate panel, API credentials, active sessions and generated keys.
- You must protect passwords, authentication codes, API secrets, tokens and decryption keys. Do not sell or share account credentials.
- Notify Support immediately if you suspect unauthorised access or misuse.
- We may require email, identity or payment verification to prevent fraud or comply with law.
We may invalidate sessions, reset credentials, delay sensitive actions or temporarily restrict an account where reasonably necessary to protect the user, the Service or third parties.
4. User content, ownership and permissions
You retain any rights you lawfully hold in your content. By uploading content, you grant MEGALOAD a limited, non-exclusive, worldwide and royalty-free licence to host, store, copy, transmit, encrypt, decrypt when technically required by the selected feature, create technical replicas, and make the content available as directed by you. This licence exists only to operate, secure, maintain and enforce the Service and ends when the content is permanently deleted, subject to lawful retention and backup cycles.
You represent that you own the content or have every permission required to store, process and share it. You must not upload personal data about another person unless you have a valid legal basis and provide any legally required notice.
Share links may be accessed by anyone who receives them unless a specific access-control feature is enabled. You are responsible for selecting the correct visibility. If client-side encryption is used, MEGALOAD may be unable to recover the decryption key. Keep your own secure copy.
5. Acceptable Use Policy
You must not use MEGALOAD to create, upload, store, share, request, promote or facilitate content or activity that is illegal or violates the rights of another person.
Zero tolerance: Child sexual abuse material, sexual exploitation of minors, credible threats, terrorist content where prohibited by law, non-consensual intimate imagery and malware intended to harm others are strictly prohibited and may be reported to competent authorities.
Prohibited content and conduct include:
- copyright, trademark, trade-secret or other intellectual-property infringement;
- child exploitation, grooming, sexual abuse material, trafficking or content that endangers a minor;
- non-consensual intimate imagery, unlawful surveillance, doxxing, stalking, harassment or unlawful disclosure of personal data;
- malware, ransomware, spyware, credential theft, phishing, botnets or malicious scripts;
- terrorist content, credible threats, incitement to violence or other content prohibited under applicable law;
- fraud, impersonation, deceptive payments, stolen payment methods, chargeback abuse or money laundering;
- spam, artificial traffic, automated reward manipulation or deceptive referrals;
- attempts to bypass plan limits, file-size rules, waiting periods, security measures or access restrictions;
- unauthorised scanning, scraping, reverse engineering, network interference or disproportionate automated requests;
- use that consumes unreasonable resources or creates risk for MEGALOAD, storage providers or other users.
You may conduct authorised security testing only with our prior written permission and within the approved scope.
6. Content moderation and enforcement
We may investigate content or conduct after receiving a notice, detecting technical abuse, identifying a security risk, or conducting a voluntary review. Depending on the circumstances, we may restrict visibility, disable a link, quarantine or delete a file, reject or reverse a reward, suspend payments, limit functionality, invalidate keys, suspend an account or terminate access.
Moderation may use automated signals such as hashes, file metadata, traffic anomalies, malware indicators, repeated-notice history and fraud rules. Automated signals may trigger a restriction or human review. We seek to apply restrictions diligently, objectively, proportionately and without arbitrary discrimination, taking account of the rights and legitimate interests of affected parties.
Where required by law and where valid contact information is available, we will provide a clear reason for a restriction and available redress options. Information may be withheld where disclosure is prohibited, would compromise security or fraud prevention, or could prejudice an investigation.
An affected user may request review through Support, identifying the account, file or decision and providing relevant evidence.
7. Illegal-content and copyright notices
Anyone may report allegedly illegal or rights-infringing content through the electronic Abuse Report mechanism. A sufficiently precise notice should include:
- the exact MEGALOAD URL identifying the content;
- a clear explanation of why the content is illegal or infringes identified rights;
- for intellectual-property notices, identification of the protected work and the reporting party’s authority;
- the reporting party’s name and email address, except where law permits omission;
- a good-faith statement that the information and allegations are accurate and complete.
We may request additional information when a notice is incomplete. Valid notices are processed in a timely, diligent, non-arbitrary and objective manner. Where contact information is supplied, we will provide confirmation and information about the outcome and available redress as required by law.
Users who believe content was restricted in error may submit a reasoned counter-notice or appeal through Support. Repeat infringement, repeated illegal-content violations, abuse of the notice process or fraudulent counter-notices may result in account termination.
8. Guest, Free, Premium and Business plans
Each plan may define storage capacity, maximum file size, upload and download speed, daily traffic, concurrent connections, threads, waiting time, retention, resume support, FTP, WebDAV, API access and other features. The limits displayed on the plan or checkout page at purchase form part of the contract.
“Unlimited” means that no fixed numerical limit is applied to that specific feature under normal and lawful use. It does not permit abusive, automated, fraudulent or resource-exhaustive use and remains subject to reasonable technical, security and network management.
Plan benefits apply only during the active subscription. When a paid plan expires or is downgraded, the account and files may become subject to the resulting plan’s limits and retention rules after any stated grace period.
9. Prices, payments, taxes and renewal
- Prices, currency, duration and benefits are shown before payment. Applicable taxes, including VAT where required, may be displayed separately.
- Payments may be processed by an authorised third-party provider whose own terms may apply.
- You authorise the selected payment and confirm that you may use the payment method.
- Activation follows successful confirmation. Delayed, reversed, fraudulent or charged-back payments may cause suspension or withdrawal.
- No recurring charge will be made unless recurring billing, frequency and cancellation are clearly disclosed and expressly authorised before purchase.
Invoices or payment records are supplied where offered or legally required. Business customers and resellers are responsible for their accounting, tax, invoicing and consumer obligations.
10. Consumer withdrawal, refunds and conformity
If you are an EEA consumer, you may have a statutory 14-day right to withdraw from a distance contract, subject to legal exceptions. If you expressly request immediate performance during that period, you may be required to pay a proportionate amount for service already supplied. For digital content not supplied on a tangible medium, the right may be lost after performance begins only where the legally required prior express consent and acknowledgement have been obtained.
Nothing in these Terms excludes statutory remedies for failure to supply or lack of conformity. Where mandatory law applies, you may be entitled to have the Service brought into conformity, receive a proportionate price reduction, or terminate the contract under the applicable conditions.
Outside mandatory rights, refunds are evaluated under the terms disclosed at checkout and the circumstances of the request. Used reseller credit, redeemed keys, completed affiliate payments, fraudulent transactions, abuse-related suspensions and third-party payment fees may be non-refundable where permitted by law.
To exercise a statutory right, contact Support with the account email, transaction reference and requested remedy.
11. Storage retention, Trash and permanent deletion
Retention is controlled by the applicable plan, guest-upload settings and administrative policies displayed in the Service. Inactivity may be calculated from the latest completed download or, if none exists, from the upload date. A value of zero may mean active files do not expire for inactivity while that plan remains active, but this is not a guarantee of perpetual storage.
Expired or user-deleted files may first enter Trash for the configured period. Afterwards, an ObjectDelete operation may permanently remove the stored object from its assigned storage node. Deletion may require processing time across distributed systems. Limited residual copies may remain temporarily in security, disaster-recovery or legally required records until normal expiry.
Guest uploads may be deleted automatically after the displayed retention period. Files may be removed sooner for abuse, security, legal orders, payment reversal, account termination or technical integrity.
Keep your own backup. MEGALOAD is not an archival guarantee, and permanently deleted files or lost encryption keys may not be recoverable.
12. Official software, downloads and API access
The official MEGALOAD Downloader/Uploader and related software are licensed, not sold, for lawful use with the Service. You may not redistribute modified versions, remove security controls, impersonate the official application, extract credentials or bypass limits.
Third-party download managers are not supported unless expressly stated. API access is available only where enabled and may require separate credentials and conditions. We may revoke compromised credentials, deprecate old versions, enforce minimum versions and rate-limit requests.
13. Reseller programme
Reseller access requires approval. Resellers may purchase genuine MEGALOAD keys at prices and bonus levels shown in their reseller panel and resell them at independently determined lawful prices.
- Each reseller is responsible for its customers, advertising, invoices, taxes, refunds and legal obligations.
- A reseller must not claim to be MEGALOAD, bind MEGALOAD, promise unsupported features or use misleading marketing.
- Keys and balances are account-specific and must not be guessed, duplicated, manipulated or generated outside approved tools.
- Cancelled, refunded, fraudulent or charged-back transactions may result in key cancellation, subscription cancellation and balance correction.
- No territory or exclusivity is granted unless confirmed by a separate written agreement signed by an authorised MEGALOAD representative.
14. Affiliate and rewards programme
Affiliate participation requires approval and compliance with the rules displayed in the affiliate panel. Rewards may depend on country tier, file size, verified completed downloads, account status, per-IP limits, anti-fraud checks, policy overrides and payment thresholds.
Self-downloads, affiliate-to-affiliate downloads, automated traffic, proxy or bot traffic, artificial downloads, misleading promotion and manipulation are not payable. Potential earnings are not final until validated. We may reject or reverse invalid credit, request verification, delay review or suspend access where reasonably necessary.
Affiliates are independent participants responsible for taxes, disclosures and lawful marketing. Participation does not create employment, agency, partnership, franchise or exclusivity.
15. Data protection and privacy notice
MEGALOAD processes account details, authentication and session data, billing references, support communications, IP addresses, device and application information, upload and download events, file metadata, abuse reports, security logs, affiliate or reseller records, and information needed to provide and protect the Service.
Purposes and legal bases
- Contract: accounts, storage, transfers, subscriptions, keys, reseller and affiliate functions.
- Legal obligations: tax records, lawful orders, fraud prevention and regulatory cooperation.
- Legitimate interests: security, abuse prevention, troubleshooting, enforcement, analytics and defence of legal claims, balanced against user rights.
- Consent: optional communications, non-essential cookies or other processing where legally required. Consent may be withdrawn prospectively.
Information may be shared with infrastructure and storage providers, payment processors, email and support providers, professional advisers, fraud-prevention services and competent authorities where necessary and lawful. International transfers, where applicable, must use a lawful mechanism.
Data is retained only as long as needed for its purpose, the contractual relationship, security and dispute periods, or legal duties. File retention is described above. Security, payment and abuse records may be retained longer where necessary or required.
Subject to applicable law, users may request access, correction, deletion, restriction, portability or objection, and may withdraw consent through Support. Identity may be verified first. Users may also lodge a complaint with the data-protection authority competent for their habitual residence, place of work or the place of the alleged infringement. A list of EEA supervisory authorities is available from the European Data Protection Board.
Essential cookies and local storage may be used for authentication, security, preferences and core functions. Non-essential cookies should be used only with legally required notice and choice.
16. Availability, maintenance and security
We use reasonable measures to operate and protect the Service, but uninterrupted or error-free availability cannot be guaranteed. Transfers may be affected by maintenance, storage-node availability, routing, internet conditions, software versions, security controls, force majeure or third-party infrastructure.
We may temporarily pause functions to protect systems, investigate abuse, perform maintenance or comply with law. Status indicators and estimates are informational and may change.
You must promptly install important application and security updates. Refusal to install a properly notified necessary update may affect remedies to the extent permitted by law.
17. Disclaimers and limitation of liability
Nothing in these Terms excludes liability that cannot lawfully be excluded, including mandatory consumer rights and liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence where applicable.
To the maximum extent permitted by law, MEGALOAD is not liable for indirect, incidental, special, punitive or consequential loss, loss of profit, revenue, opportunity, goodwill or data, or for user content. You are responsible for independent backups and protecting credentials and encryption keys.
For claims that may lawfully be limited, aggregate liability arising from the paid Service is limited to the amount paid directly to MEGALOAD for the affected Service during the twelve months before the event. This limitation does not apply where prohibited by mandatory law.
Business users, resellers and affiliates will indemnify MEGALOAD against third-party claims and reasonable costs resulting from unlawful content, customer relationships, tax failures, misleading marketing, infringement or material breach, to the extent permitted by law.
18. Suspension, termination and user cancellation
You may stop using the Service and request account closure through Support. First download any files and records you wish to retain. Closure does not automatically create a refund right.
We may suspend or terminate access for a serious or repeated breach, illegal content, security risk, payment reversal, fraud, sanctions or legal obligations. Where appropriate and legally required, we will provide warning, reasons and an opportunity to remedy or appeal. Immediate action may be taken for urgent, severe or unlawful conduct.
Provisions that should survive termination remain effective, including payment obligations, intellectual-property provisions, disclaimers, liability limits, dispute terms and lawful record retention.
19. Changes to these Terms
We may update these Terms for legal, security, technical, payment or product changes. The current version and effective date remain publicly available here. We will provide appropriate notice of significant changes that directly affect use of the Service.
Changes apply prospectively. Continued use after the effective date constitutes acceptance where permitted by law. If mandatory law requires express consent or provides a termination right, we will follow it.
20. Governing law and disputes
These Terms are governed by the laws applicable to the MEGALOAD operating entity and by applicable European Union law, without prejudice to mandatory consumer protections and conflict-of-law rules in the consumer’s country of habitual residence.
Before formal proceedings, contact Support. Consumers may also use an applicable certified alternative dispute-resolution body. Nothing removes a consumer’s right to bring a claim before a court that has jurisdiction under mandatory law.
If a provision is invalid or unenforceable, it will be limited or removed only to the minimum necessary; the remaining provisions continue in effect. Failure to enforce a provision is not a waiver.
Relevant legal framework
Depending on the user, service and circumstances, the framework may include the Digital Services Act (EU) 2022/2065, the General Data Protection Regulation (EU) 2016/679, the Consumer Rights Directive 2011/83/EU, the Digital Content and Digital Services Directive (EU) 2019/770, applicable copyright law, and their national implementing measures as amended.
